Legal agreement between you and Asteya Tech LLC for the use of QuitStake services

These Terms and Conditions constitute a legally binding agreement. By using QuitStake, you agree to be bound by these terms. Account funds are used as financial collateral for penalties when you unblock apps outside your time allowances. Please read these terms carefully before using our service.

1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the QuitStake website located at QuitStake.com and our mobile application (collectively, the "Service") operated by Asteya Tech LLC ("we," "us," or "our"), a limited liability company organized under the laws of California with its principal place of business at 8605 Santa Monica Blvd PMB 368647, West Hollywood, California 90069-4109 US.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

QuitStake is a digital wellness platform that helps users reduce or eliminate social media usage through financial accountability. Our Service includes:

  • Web-based and mobile applications for managing account funds and blocking settings
  • Monitoring technology to detect social media usage during blocked periods
  • Payment processing for account deposits and withdrawals
  • Progress tracking and violation history features
  • Customer support and dispute resolution services

2.1 How QuitStake Works

Users add funds to their QuitStake account and configure blocking for specific social media platforms. Users set their own penalty amounts and time allowances. When users unblock apps outside their configured time allowances, a penalty is deducted from their account balance. The Service uses automated monitoring to detect violations and enforce penalties.

3. Account Funds and Payment Terms

💰 Financial Accountability Model

QuitStake uses account funds as financial collateral. You add funds to your account, and penalties are deducted when you unblock apps outside your configured time allowances. This creates accountability without fixed commitments.

3.1 Adding Funds to Your Account

  • Minimum deposit: $1.00
  • Maximum deposit: $1,000 per transaction
  • All payments processed through Stripe with applicable processing fees
  • Funds are added to your account balance immediately upon successful payment
  • Account funds remain in your account until used for penalties or withdrawn

3.2 Penalty System

Penalties are deducted from your account balance when you unblock apps outside your configured time allowances:

  • Configurable Penalties: You set your own penalty amount from predefined options (e.g., $1, $5, $10, $25, $50, $100)
  • Automatic Deduction: Penalties are automatically deducted from your account balance when violations occur
  • Daily Limit: Maximum of one penalty per calendar day (subsequent unblocks on the same day are free)
  • Insufficient Funds: If your balance is below your penalty amount, you cannot unblock apps
  • Violation History: All penalties are recorded in your violation history for tracking

3.3 Withdrawal Policy

You may request withdrawal of your remaining account balance at any time:

  • Submit Request: Use the withdrawal request form on our website or contact support at help@quitstake.com
  • Review Period: Withdrawal requests are reviewed within 5-10 business days
  • Refund Processing: Approved withdrawals are processed to your original payment method
  • Balance Verification: Only your current available balance (after any penalties) can be withdrawn
  • No Cancellation Fee: There is no fee for withdrawing your remaining balance

3.4 Payment Processing

All payments are processed by Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service:

  • Stripe Processing Fee: 2.9% + $0.30 per transaction, charged by Stripe to cover payment processing costs
  • No Markup: We pass this fee through at exactly the cost charged to us
  • Secure Processing: We do not store your payment information
  • Non-Refundable: Payment processing fees are non-refundable as they are charged by Stripe when your payment is processed

3.5 Account Funds Model (iOS)

📱 iOS Account-Based Funding

The iOS app uses an account-based funding model with flexible blocking and per-violation penalties. This section explains how account funds work specifically for iOS users.

3.5.1 How Account Funds Work

The iOS account funds model provides flexible financial accountability:

  • Deposit Funds: Add money to your QuitStake account at any time without fixed time periods
  • Flexible Blocking: Your blocking runs continuously without fixed dates
  • Configurable Penalties: Set your own penalty amount from predefined options (e.g., $1, $5, $10, $25, $50, $100, etc.)
  • Pay-Per-Violation: Penalties are deducted from your account balance only when you unblock apps outside your configured time allowances

Important: Account funds are not tied to any specific time period. Your deposited funds remain in your account until used for penalties or withdrawn through our support process.

3.5.2 Daily Penalty Limit

🛡️ Once-Per-Day Maximum

To protect you from excessive charges, the iOS app enforces a daily penalty limit. You can only be charged one penalty per calendar day, regardless of how many times you unblock apps.

  • If you unblock apps multiple times in a single day, only the first unblock incurs a penalty
  • Subsequent unblocks on the same calendar day are allowed without additional charges
  • The daily limit resets at midnight in your local timezone
  • Each new calendar day, the first unblock outside your time allowance will incur your configured penalty amount

3.5.3 Withdrawal of Account Funds

You may request withdrawal of your remaining account balance at any time through the following process:

  • Submit Request: Use the withdrawal request form on our website or contact support
  • Review Period: Withdrawal requests are reviewed within 5-10 business days
  • Refund Processing: Approved withdrawals are processed to your original payment method
  • Balance Verification: Only your current available balance (after any penalties) can be withdrawn

Note: Withdrawal requests create a support ticket for manual review. We may contact you for verification before processing large withdrawal amounts.

3.5.4 iOS Family Activity Picker and App Tokens

The iOS app uses Apple's Family Activity Picker to select apps for blocking. Due to iOS privacy restrictions:

  • App Tokens: Selected apps are represented as opaque tokens rather than identifiable app names
  • Privacy Protection: Neither QuitStake nor any third party can see which specific apps you have selected to block
  • On-Device Processing: App selection and blocking enforcement happens entirely on your device
  • Token Persistence: Your app selections are stored locally and persist across app sessions

This privacy-preserving approach means that when you contact support, we cannot see which apps you have blocked. You may need to describe your app selections if relevant to your support request.

3.5.5 Platform-Specific Models

📊 Account Funds Model

QuitStake uses an account-based funding model across all platforms:

  • iOS App: Account-based model with flexible blocking and per-violation penalties
  • Android & Chrome Extension: Legacy features may still reference older terminology

The account-based model provides flexibility while maintaining the financial accountability that makes QuitStake effective.

If you use QuitStake on multiple platforms, your account funds and penalties are tracked in your central account balance.

4. User Accounts and Responsibilities

4.1 Account Creation

To use our Service, you must:

  • Be at least 18 years old or have parental consent
  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Verify your email address before adding funds

4.2 User Conduct

You agree not to:

  • Attempt to circumvent our monitoring technology
  • Use VPNs, proxies, or other methods to evade detection
  • Create multiple accounts to avoid penalties
  • Provide false information in disputes
  • Interfere with the proper functioning of the Service
  • Use the Service for any illegal or unauthorized purpose

5. Monitoring Technology and Privacy

5.1 Monitoring Consent

By using our Service, you explicitly consent to network monitoring on devices where you install our application. Our monitoring technology:

  • Detects when you access blocked social media platforms
  • Collects metadata about network connections (not content)
  • Operates continuously while blocking is active
  • May detect usage across multiple devices and browsers

5.2 Privacy Protection

We are committed to protecting your privacy:

  • We never access your personal content, messages, or passwords
  • Only network metadata is collected for monitoring purposes
  • All data is encrypted in transit and at rest
  • Data is automatically deleted 30 days after you disable blocking
  • We comply with GDPR, CCPA, and other applicable privacy laws

6. Dispute Resolution

6.1 Violation Disputes

If you believe you were incorrectly penalized for a violation, you may dispute it by:

  • Emailing help@quitstake.com within 48 hours of the alleged violation
  • Providing a clear explanation and any supporting evidence
  • Allowing up to 5 business days for our review

6.2 Valid Dispute Grounds

Disputes may be approved for:

  • Technical false positives in our monitoring system
  • Legitimate work-related social media access (with documentation)
  • Emergency situations requiring social media communication
  • Service outages or technical issues on our end

6.3 Dispute Limitations

Disputes will NOT be approved for:

  • Personal emergencies that could be handled through other communication methods
  • Accidental or brief access to blocked platforms
  • Desire to modify your penalty settings or time allowances
  • Financial hardship or change of mind

6.4 Approved Dispute Resolution

If your dispute is approved, the penalty will be refunded to your account balance within 5-10 business days.

7. Limitation of Liability

Our liability is strictly limited as described below. By using our Service, you acknowledge and accept these limitations.

7.1 Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. We are not liable for:

  • Service outages or technical difficulties
  • Monitoring failures due to technical issues
  • Third-party service interruptions (including Stripe)
  • Internet connectivity issues

7.2 Maximum Liability

In no event shall Asteya Tech LLC's total liability to you exceed the amount of your current account balance. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

7.3 Health and Wellness Disclaimer

QuitStake is a digital wellness tool, not medical treatment. We make no claims about health outcomes. Consult healthcare professionals for addiction treatment or mental health concerns.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Asteya Tech LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Termination

9.1 Termination by You

You may terminate your account at any time. You may request withdrawal of your remaining account balance through our support process.

9.2 Termination by Us

We may terminate or suspend your account immediately for violations of these Terms, including:

  • Attempting to circumvent monitoring technology
  • Providing false information
  • Abusing our dispute process
  • Violating applicable laws

Upon termination, any remaining account balance may be forfeited depending on the reason for termination.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Los Angeles County, California.

11. Arbitration Agreement

Most disputes must be resolved through binding arbitration rather than court proceedings. This affects your legal rights - please read carefully.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in Los Angeles County, California.

11.1 Exceptions to Arbitration

The following disputes are exempt from arbitration:

  • Small claims court actions (under $10,000)
  • Intellectual property disputes
  • Injunctive relief requests

11.2 Class Action Waiver

You agree that any arbitration shall be conducted in your individual capacity only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email and prominent notice on our website. Continued use of the Service after changes constitutes acceptance of new Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Asteya Tech LLC regarding the use of the Service and supersede all prior agreements and understandings.
