1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the QuitStake website located at QuitStake.com and our mobile application (collectively, the "Service") operated by Quit Tech LLC ("we," "us," or "our"), a limited liability company organized under the laws of California with its principal place of business at 1377 Sonoma Drive, Altadena, California, 91001.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

QuitStake is a digital wellness platform that helps users reduce or eliminate social media usage through financial commitment devices. Our Service includes:

• Web-based and mobile applications for creating and managing commitments
• Network monitoring technology to detect social media usage
• Payment processing for financial stakes and refunds
• Progress tracking and reporting features
• Customer support and dispute resolution services

2.1 How QuitStake Works

Users create "stakes" by paying money upfront and committing to avoid specific social media platforms for a defined period. Users earn back portions of their stake for each successful day. If users access blocked platforms, they forfeit that day's potential earnings. The Service uses automated monitoring to detect violations.

3. Financial Commitments and Payment Terms

3.1 Stake Requirements

• Minimum stake: $1.00 per day of commitment
• Maximum stake: $1,000 per commitment
• All payments processed through Stripe with applicable processing fees
• Stakes must be paid in full before commitment begins
• Service fees apply after your 7-day free trial period expires

3.2 Service Fees

Service fees help cover platform costs including payment processing, monitoring technology, customer support, and system maintenance:

• New Members: No service fees for 7 days from account registration
• After Trial: Standard service fee applies to all new stakes
• Fee Structure: Fixed fee per stake (amount displayed during checkout)
• Non-Refundable: Service fees are not refundable, even with successful completion
• Backend Validation: All service fees are validated server-side to prevent manipulation

3.3 Refund Policy

Refunds are earned through successful completion of daily commitments according to the following terms:

• Successful Days: You earn back a pro-rated portion of your stake for each day you successfully avoid blocked platforms
• Violations: You forfeit that day's potential earnings but may continue earning for subsequent days
• Complete Success: Users who complete their entire commitment without violations receive 100% of their stake back
• Processing Time: Refunds are processed within 5-10 business days through your original payment method
• No Cancellations: Stakes cannot be canceled once payment is processed, regardless of circumstances

3.4 Payment Processing

All payments are processed by Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service. We do not store your payment information. Processing fees are non-refundable.

4. User Accounts and Responsibilities

4.1 Account Creation

To use our Service, you must:

• Be at least 18 years old or have parental consent
• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Verify your email address before creating stakes

4.2 User Conduct

You agree not to:

• Attempt to circumvent our monitoring technology
• Use VPNs, proxies, or other methods to evade detection
• Create multiple accounts to avoid commitments
• Provide false information in disputes
• Interfere with the proper functioning of the Service
• Use the Service for any illegal or unauthorized purpose

5. Monitoring Technology and Privacy

5.1 Monitoring Consent

By using our Service, you explicitly consent to network monitoring on devices where you install our application. Our monitoring technology:

• Detects when you access blocked social media platforms
• Collects metadata about network connections (not content)
• Operates continuously during your commitment period
• May detect usage across multiple devices and browsers

5.2 Privacy Protection

We are committed to protecting your privacy:

• We never access your personal content, messages, or passwords
• Only network metadata is collected for monitoring purposes
• All data is encrypted in transit and at rest
• Data is automatically deleted after your commitment ends
• We comply with GDPR, CCPA, and other applicable privacy laws

6. Dispute Resolution

6.1 Violation Disputes

If you believe you were incorrectly penalized for a violation, you may dispute it by:

• Emailing help@quitstake.com within 48 hours of the alleged violation
• Providing a clear explanation and any supporting evidence
• Allowing up to 5 business days for our review

6.2 Valid Dispute Grounds

Disputes may be approved for:

• Technical false positives in our monitoring system
• Legitimate work-related social media access (with documentation)
• Emergency situations requiring social media communication
• Service outages or technical issues on our end

6.3 Dispute Limitations

Disputes will NOT be approved for:

• Personal emergencies that could be handled through other communication methods
• Accidental or brief access to blocked platforms
• Desire to cancel or modify your commitment
• Financial hardship or change of mind

7. Limitation of Liability

7.1 Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. We are not liable for:

• Service outages or technical difficulties
• Monitoring failures due to technical issues
• Third-party service interruptions (including Stripe)
• Internet connectivity issues

7.2 Maximum Liability

In no event shall Quit Tech LLC's total liability to you exceed the amount of your current stake. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

7.3 Health and Wellness Disclaimer

QuitStake is a digital wellness tool, not medical treatment. We make no claims about health outcomes. Consult healthcare professionals for addiction treatment or mental health concerns.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Quit Tech LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Termination

9.1 Termination by You

You may terminate your account at any time, but active commitments cannot be canceled and will continue until completion.

9.2 Termination by Us

We may terminate or suspend your account immediately for violations of these Terms, including:

• Attempting to circumvent monitoring technology
• Providing false information
• Abusing our dispute process
• Violating applicable laws

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Los Angeles County, California.

11. Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in Los Angeles County, California.

11.1 Exceptions to Arbitration

The following disputes are exempt from arbitration:

• Small claims court actions (under $10,000)
• Intellectual property disputes
• Injunctive relief requests

11.2 Class Action Waiver

You agree that any arbitration shall be conducted in your individual capacity only and not as a class action or other representative action. You expressly waive your right to file a class action or seek relief on a class basis.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email and prominent notice on our website. Continued use of the Service after changes constitutes acceptance of new Terms.

Changes will not affect existing commitments, which will be governed by the Terms in effect when the commitment was created.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Quit Tech LLC regarding the use of the Service and supersede all prior agreements and understandings.
